Advertising Policy
JMIR Publications (JMIR) accepts commercial advertising for its journal publications, web site, and other digital properties.
These policy guidelines are developed to ensure advertising upholds both JMIR’s editorial and ethical standards.
The appearance of advertising in JMIR’s properties is neither a guarantee nor an endorsement by JMIR of the product or the claims made for the product in such advertising.
To maintain JMIR’s publishing integrity, advertising cannot influence editorial decisions or editorial content. JMIR’s advertising sales representatives have no prior knowledge of specific editorial content before it is published, and decisions to sell advertising space are made independently of specific editorial content.
Guidelines
1. All submitted advertising content is subject to approval by JMIR staff and must comply with the guidelines. JMIR retains sole right to reject and/or request modifications to the advertisement.
a. In such an event, JMIR will use reasonable efforts to provide the advertiser with notification to allow the advertiser to modify or supply an alternate advertisement. Advertisers are not entitled to any compensation for rejected advertisements.
2. The advertiser will be responsible for the advertising material and warrants that:
a. The advertiser is authorized to sell all products and/or services advertised
b. it has the right to use any information, trademarks, service marks or trade names depicted in the ad material/advertising
c. the ad material/advertising complies with all applicable laws and regulations in the jurisdiction where it will be seen.
d. The advertiser assumes responsibility for the registration and protection of any copyright it may have in its own advertising and licenses to JMIR the right to copy from such advertising.
3. JMIR does not accept advertising content related to tobacco, alcohol, recreational drugs, pornography, or any products t in geographies where the advertising will be displayed.
4. JMIR does not accept advertising content explicitly promoting pharmaceutical drugs.
3. Statements in advertising copy should be ethical and carry no direct or implied disparagement of another product. There should be no statements that are misleading, exaggerated, or contrary to proven facts.
5. Advertising content for any JMIR competitor product or service will be subject to special approval by JMIR staff.
4. The advertiser will indemnify, defend, and hold harmless JMIR from and against any expenses arising from any claims, losses, or damages arising from the advertising material, including, but not limited to, third party claims alleging trademark or copyright infringement.
6. All advertisements must clearly and prominently identify the advertiser by trademark or signature.
7. Ads must be nondiscriminatory and comply with all applicable laws and regulations in geographies where the advertising will be displayed.
8. Advertisements that appear on a publication’s website adjacent to articles must display randomly and cannot display based on the subject matter of the article.
9. Advertising cancellations must be submitted in writing at least three (3) business days prior to the scheduled campaign start date. For cancellations received less than 3 days prior to the campaign start date, the advertiser will be responsible for payment of one month’s net cost of the advertisement.
11. JMIR will not be liable for any failure to publish an accepted advertisement, and will use reasonable efforts to place the advertisement in subsequent available space.
12. If the advertising material supplied by the advertiser is not compliant with JMIR’s requirements as set forth in these guidelines and in the media kit, JMIR will not be liable for any errors in rendering of the advertisement. In the event JMIR is responsible for any rendering errors in an advertisement, JMIR’s liability will not exceed a reproduction of the advertisement.
15. Copyright and other intellectual property rights to all JMIR proposals, publications and other products shall remain with JMIR unless agreed otherwise in writing signed by both parties. The advertiser shall not acquire any intellectual property rights in the products. No part of the JMIR proposals, publications or products may be stored in any automated data file and/or reproduced, whether electronically, mechanically, by photocopying, recording or in any other manner or form, without the specific prior written permission of JMIR.
16. JMIR shall have the right, at any time, to remove any advertisement and/or terminate this agreement if JMIR determines, in its sole discretion, that the advertisement:
a. violates JMIR’s policies
b. violates any law, rule or industry regulation, or if JMIR is directed to do so by any law enforcement agency, court or government agency
c. is the subject of a claim asserted by an entity with respect to its trademarks, trade names, service marks or other proprietary rights
d. is otherwise objectionable to JMIR.
17. JMIR reserves the right to cancel any order in the event the advertiser is more than thirty days late in remitting payment for an invoice or in the event the advertiser becomes the subject of a bankruptcy or other proceeding relating to insolvency.
